Terms of Service

Introduction

Welcome to Flatpals, a platform operated by Catchi s.r.o. a company registered in Slovakia. Flatpals is designed to connect individuals seeking shared flats with those offering rental spaces. These Terms of Service ("Terms") govern your use of the Flatpals platform, including our website, flatpals.cz, flatpals.com, flatpals.at, flatpals.de and any related services (collectively, the "Platform").

Acceptance of Terms

• Non-Logged-In Users: By accessing or using the Platform without an account, you accept these Terms.
• Logged-In Users: To create an account, you must explicitly agree to these Terms by checking the designated checkbox during registration.

Eligibility & Accounts

• Age Requirement: You must be at least 18 years old to use Flatpals.
• Account Responsibility (Logged-In Users): You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.
• Single Account (Logged-In Users): Each user may maintain only one account, and accounts may not be shared or transferred.
• Non-Logged-In Users: Users accessing the Platform without an account are still bound by these Terms but cannot create listings or access certain features available only to logged-in users.
• Automatic Registration Across Affiliated Platforms: When you register for an account on Flatpals, your account will automatically be created and accessible on our affiliated platforms, flatpals.cz, flatpals.at, flatpals.de and flatpals.com, as these platforms share the same monolith server and account system. This means your account credentials, profile information, and any content you post (e.g., listings) may be accessible or displayed across all three platforms. You only need to maintain one account to access all three platforms, and any updates or deletions to your account on one platform will apply to all. For details on how your personal data is processed across these platforms, please refer to our Privacy Policy. By registering, you consent to this shared account system and the associated data processing.

Flatpals’ Role

• Intermediary Platform: Flatpals is a matching platform that facilitates connections between users seeking or offering shared flats. Flatpals does not own, manage, or control any properties listed on the Platform.
• No Guarantee of Outcomes: Flatpals does not guarantee the availability, quality, or suitability of any listings, nor the outcome of any rental agreements. All rental agreements are solely between the users (e.g., tenants and landlords) and not with Flatpals.

User Content & Listings

• Content Standards (Logged-In Users): All listings and content posted on Flatpals must be accurate, lawful, and non-discriminatory. You may not post fake, misleading, or illegal content, including listings for properties you do not have the right to rent.
• Content Ownership: You retain ownership of your content but grant Flatpals a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for the purpose of operating and promoting the Platform. This includes the right to use your listing content, descriptions, and images to create promotional posts on Facebook and other social media platforms to increase visibility of your listings and help you find tenants or roommates more effectively. You may opt out of such promotional use by contacting us at hello@catchi.sk.
• Content Removal: Flatpals reserves the right to remove any listings or content that violate these Terms or are otherwise deemed inappropriate, at our sole discretion.
• Non-Logged-In Users: Non-logged-in users may view listings but cannot post content or create listings.
• Data Across Platforms: Listings and user data may be shared across flatpals.sk, flatpals.cz, flatpals.at, flatpals.de and flatpals.com to provide a unified experience and broader reach for users.

Featured Listings & Payments

• Paid Features (Logged-In Users): Landlords with accounts may purchase optional features, such as highlighted or featured listings, to increase visibility on the Platform.
• Payment Processing: All payments are processed securely via Stripe, a third-party payment processor. Flatpals does not collect, store, or process store, or process any payment information directly. You agree to provide accurate payment information to Stripe and authorize Flatpals to charge the applicable fees through Stripe.
• Non-Refundable Fees: Fees for paid features are non-refundable, except where required by applicable law.
• Pricing Changes: Flatpals reserves the right to modify pricing or features for features for paid services at any time, with reasonable notice provided to users.

Prohibited Conduct

You agree not to:

• Engage in fraudulent activities, scams, or misrepresentation.
• Harass, discriminate against, or harm other users.
• Spam, scrape, or misuse the Platform, including automated data collection.
• Violate any applicable laws or regulations.
• Interfere with the Platform’s functionality or security.

Termination

• By Flatpals: We may suspend or terminate your account (for logged-in users) or access to the Platform (for all users) if you violate these Terms or engage in conduct we deem harmful to the Platform or its users.
• By You (Logged-In Users): You may delete your account at any time by following the instructions on the Platform.
• Effect of Termination: Upon termination or deletion of your account, your access to flatpals.sk, flatpals.cz, flatpals.at, flatpals.de and flatpals.com will cease, but these Terms that by their nature should survive (e.g., liability, governing law) will remain in effect.

Liability & Disclaimer

• No Liability for Disputes: Flatpals is not responsible for any disputes, fraud, rental outcomes, or damages arising from interactions between users or from rental agreements.
• As-Is Service: The Platform is provided “as is” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, availability, or uninterrupted access. Flatpals does not guarantee that the Platform will be Platform will be available at all times or free from errors, and we may experience downtime or disruptions due to maintenance, technical issues, or other factors.
• Limitation of Liability: To the fullest extent permitted by law, Flatpals and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or any interruptions in service.

Governing Law & Dispute Resolution

• Applicable Law: These Terms are governed by the laws of Slovakia and applicable European Union regulations.
• Jurisdiction: Any disputes arising from these Terms or your use of the Platform will be resolved in the competent courts of Slovakia.
• Informal Resolution: Before pursuing formal legal action, we encourage you to contact us to resolve disputes informally.

Changes to Terms

Flatpals may update these Terms from time to time. We will will notify logged-in users of material changes via email or through the Platform. Non-logged-in users are responsible for reviewing the Terms periodically. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.
